Just something to check out...
This is tangentially related to our material from this past week. Last summer, This American Life (my favorite radio show) did an episode called Origin Story. In it they explore the genesis of the state secrets privilege, which allows the government to have lawsuits thrown out on the grounds that litigating them would cause the government to have to reveal sensitive state secrets.
